PRIVACY NOTICE

on the processing of personal data within the Referral Program

Scope:

LLC “DYNATECH” (hereinafter referred to as “DYNATECH”, “we”, “our”, “us”), Jeruzalemes iela 1, Rīga, LV-1010, organises the Referral Program in order to attract job candidates. 

This notice relates to natural persons (Referring Person, “you, “your”) who referred their friends as job candidates.

Your obligations and liability

If you participate in our Referral Program and are ready to share the CV of your friends we assume that you have notified the friend that you: 

• will share their CV with us and we will process the friend’s data in accordance with the Privacy Notice; 
• will respect any objections received from your friends regarding their CV and other data processing for recruitment purposes; 
• will know whether your friend failed or succeeded during the trial period (we provide rewards only if your friend successfully completes the trial period). 

If you ignore friends’ objections and don’t report them to us we disclaim all responsibility which may be imposed on us as a data controller. 

Your data processing conditions

DYNATECH is the controller of your personal data.

BASIS and PURPOSES of data processing:

1. Your data will be processed on a contractual basis solely for the purposes of providing rewards (e.g. a money reward) promised within the Referral program. 
2. If you receive rewards under the referral Program, Latvian laws require us to calculate taxes and process your data within our accounting system. As a result, we will submit your personal data to the local tax authorities. 
3. Due to possible legal claims we need to retain the minimum necessary personal data to establish and exercise our rights and to defend against such legal claims. 

The RECIPIENTS of your data are: yourself (a data subject), our employees and the tax authorities.

Criteria for determining data RETENTION periods:

1. In case you receive awards (your friend is selected for employment and completes the trial period), your data will be stored for as long as necessary to achieve the PURPOSES set forth above, but not for more than 5 years.
2. In other cases we will store  the minimum necessary personal data to establish and exercise our rights and to defend against legal claims.

By providing us with data, you have the following RIGHTS to:

• request access to your personal data from the controller;
• modify or update data to facilitate the accomplishment of the purpose (i.e. to receive rewards);
• request deletion of your data by the controller (in cases specified in applicable legislation);
• request restriction of the processing of your data by the controller (in cases specified in applicable legislation);
• object to the processing of your data (in cases specified in applicable legislation);
• request the forwarding of the data to another controller (the right to portability), if technically feasible, and in accordance with other provisions related to data security;
• file a complaint with the Data State Inspectorate.

If we have to pay rewards you have to provide the minimum necessary data required by accounting and tax laws. If you fail to provide such data we will not be able to provide rewards.
